Description: 8vo (8 × 5¼ in): t-p., 360, [39] p. Contemporary unlettered calf. · Register: · Condition: Joints cracked, leather torn at lower outer corner of bottom board. Interior clean, bright. · Comments: 'Ejectment' was originally a proceeding for a tenant for years to recover possession of land from which someone (other than his landlord) had 'ejected' him. Eventually, the courts allowed any person claiming a right to possession of land as his freehold to sue in the name of a fictitious lessee another fictitious party who was supposed to be the lessee of the true defendant. Thus, ejectment became the ordinary means for anyone to recover possession of land. Because a term of years was personal property, the action was personal rather than real in nature; thus, the dilatory aspects of the real actions were avoided. This treatise covers the niceties of the practice and procedure in an analytical method, starting with the history of the action and proceeding through its various stages. · References: ESTC T120836.
