In December, 1952, the Supreme Court heard arguments for this case and for Brown v. Board of Education of Topeka, but held the cases over. For this second and final argument, the Court instructed the parties to discuss whether Congress, in passing the Fourteenth Amendment, intended it to outlaw racial segregation in public schools.

This brief, by Prince Edward County, Virginia, demonstrates the South's arguments to buttress segregation, saying that separation of the races was a reasonable and constitutionally permissible decision. In the event of an adverse decision, they request that a strict timetable for desegregation should not be imposed. In May, 1954, the court decided both cases together, outlawing racial segregation of public schools.
